Warranty Terms and Conditions of Klavierausstellung Mister Piano
1. Voluntary Warranty
Klavierausstellung Mister Piano grants the initial purchaser of a new or used instrument purchased from them a voluntary warranty of 24 months from the invoice date, in addition to the statutory warranty rights. This warranty is valid exclusively within Germany, unless otherwise agreed in writing. The buyer's statutory rights, in particular the statutory warranty according to §§ 437 ff. BGB (German Civil Code), remain unaffected by this warranty and are not restricted by it.
2. Subject Matter of Warranty
The warranty exclusively covers demonstrable material, manufacturing, or construction defects that significantly impair the usability or functionality of the instrument. The warranty refers exclusively to the technical condition of the instrument at the time of handover. No warranty is expressly provided for: specific sound characteristics, subjective sound perceptions, tuning stability, normal aging processes, optical characteristics, surfaces, finishes, veneers, felts, strings, hammerheads, rollers, pedal noises, regulatory customary readjustments, climatically induced changes, or normal wear and tear.
3. Prerequisites for Warranty
The prerequisites for all warranty claims are: proper use of the instrument, adherence to usual climatic conditions, regular care, at least one professional tuning and maintenance per calendar year. Maintenance may only be performed by: Klavierausstellung Mister Piano, or a demonstrably qualified piano builder or specialist company. The buyer is obliged to present corresponding proofs upon request. If maintenance or tunings are not proven, the warranty lapses completely.
4. Exclusion of Warranty
Excluded from the warranty are, in particular, damages or defects resulting from: improper handling, incorrect operation, neglected maintenance, excessive use, commercial use if the instrument was sold for private use, climatic influences (humidity, dryness, temperature fluctuations, sun exposure), pest infestation, liquid damage, transport damage after handover, force majeure, interventions or repairs by unauthorized third parties, alterations to the instrument, use of unsuitable accessories, normal wear and tear. Also excluded are: retuning, voicing work, regulation work, minor extraneous noises, optical changes, age-related changes, consumables, and wear and tear parts.
5. Processing of Warranty Cases
Warranty claims must be reported in writing to Klavierausstellung Mister Piano immediately after the defect occurs. The notification must include: original or copy of the purchase receipt, proof of maintenance/tunings, description of the defect, meaningful photos or videos upon request. Written consent from the company must be obtained before carrying out independent repairs. Unauthorized repairs or alterations lead to the complete expiration of the warranty.
6. Scope of Warranty Service
In the event of a justified warranty claim, Klavierausstellung Mister Piano alone decides on the type and scope of the service. The warranty includes, at the seller's discretion: rectification, repair, replacement of individual components, or replacement delivery with an equivalent instrument. Multiple rectifications are permissible. A right to conversion, withdrawal, reduction, or payout does not exist within the scope of this warranty. Replaced parts become the property of the company.
7. Transport and Accessibility
Transport, floor, crane, assembly, or other logistics costs will only be borne if legally mandatory or explicitly agreed upon in writing. The buyer must ensure that the instrument is freely accessible. Additional expenses due to difficult accessibility are at the buyer's expense.
8. Limitation of Liability
Liability under this warranty is limited to the extent expressly regulated in these warranty conditions. For indirect damages, consequential damages, loss of profit, loss of use, or other financial losses, Klavierausstellung Mister Piano is only liable in cases of intent or gross negligence, as well as in cases of mandatory statutory liability. Liability under the Product Liability Act and for injury to life, body, or health remains unaffected.
9. Statute of Limitations and Warranty Period
The warranty period is 24 months from the invoice date. Warranty services rendered do not extend or renew the warranty period.
10. Final Provisions
Should individual provisions of these warranty conditions be or become wholly or partially ineffective, the validity of the remaining provisions shall remain unaffected. German law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
